When is a Special Use Permit Needed?
A Special Use Permit is necessary when a resident wishes to use his/her property for a purpose that is not permitted in a particular zoning district.
When is a Zoning Variance Needed?
A Zoning Variance is necessary when a proposed development cannot comply with the applicable zoning regulations. For example, problems such as exceptional narrowness, inadequate depth or irregular shape would be considered impractical conditions which may require a Zoning Variance.
What is the Procedure to Apply for a Special Use Permit, Zoning Variance or Rezoning?
- The applicant discusses the project with the Planning and Redevelopment Division.
- The applicant submits a letter to the Mayor and City Council requesting permission to apply (for Special Use Permit only).
- An application is filed with the planning and redevelopment division three weeks prior to the public hearing. A $80 filing fee is paid at this time ($100 for a Rezoning).
- Planning and Redevelopment staff processes the application.
- The application/request is either approved or denied by the City Council or Board of Zoning Appeals as appropriate.
- Planning and Redevelopment staff officially notify the applicant of the decision by letter (for Zoning Variances only).
- One week after the Planning Commission public hearing, City Council reviews the request and makes the final decision (for Rezoning only).
